Welcome to Hoku! These Terms of Use (“Terms”) govern your access to and use of our Hoku travel planning application (“App”). By using our App, you agree to comply with these Terms. If you do not agree, please do not use the App.

1. Use of the App

1.2. You agree to use the App only for lawful purposes and in accordance with these Terms.

1.3. We reserve the right to modify or discontinue any part of the App at any time without notice.

1.4. The App may be unavailable from time to time due to maintenance, updates, or technical issues.

2. Account Registration

2.1. You may be required to create an account to access certain features.

2.2. You are responsible for maintaining the confidentiality of your login credentials.

2.3. We are not responsible for any unauthorized access to your account.

2.4. By registering, you agree to receive occasional marketing emails from us. You can opt out at any time via the unsubscribe link in those emails.

3. Trip Planning and Bookings

3.1. Our App provides travel planning tools but does not guarantee availability or pricing of third-party services.

3.2. We are not responsible for the quality, safety, or accuracy of third-party services booked through the App.

3.3. Any transactions with third-party providers are solely between you and the provider.

4. AI-Generated Suggestions

4.1. The App may include travel suggestions generated by artificial intelligence (AI), such as recommended places, routes, or activities.

4.2. These AI-generated suggestions are informational only and not endorsements or guarantees.

4.3. We are not liable for any experiences, damages, or issues that result from following AI-generated suggestions, including activities, routes, or destinations.

5. User Content

5.1. You may submit reviews, comments, and other content (“User Content”).

5.2. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content for purposes including promotion and marketing.

5.3. We may moderate or remove any User Content that violates these Terms or is deemed inappropriate.

6. Prohibited Activities

6.1. You may not:

•Use the App for fraudulent or unlawful purposes.

•Interfere with the operation of the App.

•Post or share misleading, inappropriate, or offensive content.

•Attempt to access or tamper with the App’s code, servers, or data.

7. Intellectual Property

7.1. All content, trademarks, and intellectual property within the App belong to Hoku Travel LLC.

7.2. You may not copy, modify, or distribute any part of the App without our written permission.

8. Disclaimers & Liability Limitations

8.1. The App is provided “as is” without warranties of any kind.

8.2. We make no guarantees regarding the accuracy, completeness, or reliability of information provided in the App.

8.3. We are not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the App.

9. Dispute Resolution

9.1. Any disputes arising out of or relating to these Terms will be resolved through binding arbitration in the State of Florida, USA, rather than in court.

9.2. Each party will bear its own legal costs, unless otherwise determined by the arbitrator.

10. International Use

10.1. The App may be accessed globally, but we do not guarantee it is appropriate or legal for use in all jurisdictions.

10.2. You are responsible for compliance with local laws in your location.

11. Changes to Terms

11.1. We may update these Terms from time to time. Continued use of the App after such updates constitutes your acceptance of the new Terms.

11.2. Significant changes will be communicated through the App or via email.

12.1. These Terms are governed by the laws of the State of Florida, USA.
